General terms and conditions are made to regulate the intercourse between MONGOLIAN LUXURY TRAVEL /Nomadic of Blue Sky Co.,Ltd/, which is regulated by Mongolian law, with the register numbers of 9011252010 (State number) and 5403979 (register number) and the customer or client.
As an organizer of your travel, the Agency guarantees implementation of the program as described in the arrangement that they organize and that you have received. The content of arrangement will be realized in full and as described above, except in case of exceptional circumstances (war, riots, strikes, terrorist attacks, sanitary problems, natural disasters, local authorities etc.)

By signing any such contract or payment of the full amount of the package price or a deposit, it is considered that the user understands the arrangement of the general terms and conditions of the contract and that he fully accepts them as the sole basis for the regulation of the mutual rights and obligations.

Booking and Payments

In order to confirm your space on a tour you are supposed to return a completed booking form with a deposit of 30% of tour price per person. As we receive the booking form, we will send you confirmation of your booking along with details for the payment of the balance. The booking will not be accepted and no contract made until the deposit is received. The trip balance is due 8 weeks prior to the departure date. If you are booking within the 8 weeks of the tour start date, then full payment is required at time of booking. If the balance is not paid by the due date, your reservation could be discussed as cancelation. The Company will not accept responsibility for any monies sent by post. Payment can be made by bank transfer and international money transfer services.

Cancellations

If you booked a stay and needed to cancel it, you must notify it by emailing us as soon as possible. There will be service charge of US$100 per person on cancellations received at least sixty days prior to the booked tour departure.
We set up the possible repayment by bank transfer, in the eight days of our receipt of the customer’s bank information. You will bear the possible transfer fees.

If you cancel your booking after you have paid in full the following cancellation charges will be made: 

-for cancellation up to 30 days before travel                       20% of the price

-for cancellations 29-22 days prior to departure                 30% of the price

-for cancellations 21-15 days prior to departure                 40% of the price

-for cancellations 14-08 days prior to departure                 80% of the price

-for cancellation of 7 days to the day of departure             100% of the price

these dates refer to the date we receive written notification of your cancellation. We strongly recommend you protect yourself by purchasing travel insurance. We have very rarely had to cancel a tour but reserve the right to do so for any reason. If the tour is cancelled by us, all payments will be returned in full.

Travel package content & price

The content of the travel package defines the price of the package, or correspondingly the price includes everything the tour organizer (the agency) stated in the travel programme. Additional services are not included in the price and therefore the traveller pays them separately. These additional services should be requested when registering and shall be added to the package price. Additional/optional and special services requested during the travel are to be paid directly to the tourist guide (or representative) of the company during the tour and in the local currency of the country where the service is provided. The organizer reserves the right to change the prices in case of modifications in the price of accommodation, food, transport and other services, i.e. in the case of change in the value of the currencies that are the basis for calculating the arrangement price.
Group tour prices are based on minimum of 4 people. In the case of enough people, we will be able to run these tours privately with an extra cost of USD 100-300 per person depending on number of people and departures. For the private tour, there should be 2 persons at least. The hotel charges in tours are based on twin room. Single room supplement is available upon your request.

Passport & visa

Clients must ensure that they are aware of all relevant passport and visa requirements and those they allow adequate time to obtain them. You can obtain visas from the Mongolian embassy or consulate in your country using our tour confirmation letter after the booking deposit is received. If there is no Mongolian embassy or consulate in your country, one month-long visas can be obtained on the spot once you arrive at the airport or railway station in Ulaanbaatar.

Change of programme

The tour operator has the right to change the programme if exceptional circumstances that cannot be predicted, avoided, or removed. Arranged accommodation can be replaced only by accommodation in a facility of the same or higher category, at the expense of the service provider.

Obligations of agency and passengers

The organizer is obliged to ensure that the service are performed and selection of employees is done with a care of a good organizer, to take care of travellers' rights and interests in accordance with good practices in tourism. NOMADIC OF BLUE SKY’s responsibility only starts at the designated meeting point and time i.e. when you meet the tour guide.The organizer will not be responsible in case of changes and default services caused by natural force and due to delays in transportation, where the carrier does not correspond to the applicable regulations and international conventions. In such cases, the traveller is responsible for all additional costs without the right to a refund of the costs by the Agency.

The traveler is required:

- To have valid travel documents (identity documents). The cost of loss or theft of personal documents is covered by a passenger. Associate or representative of the organizer will assist the traveller in the above situation, provided that the travel programme goes unhindered.

- To bring special requests and any medical issues or conditions to our attention at the time of booking.

- To respect the customs and currency regulations of the Mongolian law, as well as regions of stay during the trip

- To abide by the authority of the tour guide who will be working to ensure the safety and welfare of the group

- To make sure that smoking is not permitted in any vehicle.

- To follow the instructions and cooperate with tourist associate and / or a representative of travel

- To present a document on paid arrangement (voucher) at departure on travel to associate or representative of the organizers at the time of departure; this paragraph applies only to organized group travel. In the case of non-compliance with some of these obligations, the traveller is responsible to the tour operator for damages.
